How to stop fun in the country or mowing grass at 7 am? Lawmakers tackled noisy neighbors

People who have large areas (or the land is located in the distance) do not always understand what a nightmare can turn into a quiet suburban life, when a neighbor has violent parties over the fence until late, and works at dawn lawn mower. The average size of a plot in SNT is usually about 5 acres. And since May, the noise season begins in the dacha villages (barbecue, tape recorder, etc.). And there are those who come to the dacha to listen to the birdsong and take a break from the city. Sometimes conflicts come to the use of physical force or even firearms.

Silence law

The new law on silence, if not adopted at the federal level, may not affect suburban life to the extent necessary. A bill is currently being discussed that will work throughout the state. The document will be discussed during the spring session. But will there be a separate block dedicated to a quiet life in summer cottages and country houses?

About fines

A new law on silence is being developed, officials say, to protect citizens. It happens that a powerful hum from the highway makes life in a house impossible and even dangerous to health (vibrations and hum have a negative effect on the body), the residents are eventually resettled - if the harm is proven.

It is also planned to fine citizens who systematically (from two times a month) break the silence in a residential building at night - from 23:00 to 7:00. However, today this regime differs depending on the region and often only works in apartment buildings. For example, in the Samara region - from 22:00 to 8:00, and in Tatarstan - from 22:00 to 6:00 in the morning.

There is also a "quiet hour" during the day - 120 minutes, when you can't make noise. Again, this period varies depending on the area (usually from 13:00 to 15:00). In country houses, repair and construction work is carried out at night, as rarely does anyone complain about the noise.

The amount of the fine for an individual can be up to 50 thousand rubles, the minimum amount is 5 thousand rubles (while in Moscow it is from 1 to 2 thousand rubles, article 3.1 of the Code of Administrative offenses). For legal entities - 50–150 thousand rubles. In the Belgorod region, the fine for individuals is already from two thousand rubles.

In St. Petersburg, as you know, there is a very strict law on silence. The document is jokingly called "the law on the stomping of cats." You cannot turn on the TV at night, move furniture, etc. But summer residents in the Leningrad Region cannot legally ask a neighbor to stop drilling in the early morning or turn off loud music at night. Oleg Petrov, chairman of the Leningrad Oblast Legality and Order Commission, believes that at least gardening and are not listed in the law on the silence of the region, citizens can contact the chairman of SNT or even in the police.

Pavel Krasheninnikov, State Duma deputy:
“Respect should be mutual. When the impact coming from a neighboring site exceeds the standards or goes beyond the specified limits, the neighbors have the right to demand the elimination of violations. The general principle is that my rights end where the rights of others begin. "

This is not noise

Noise refers to sounds that exceed the maximum permissible level of 55 dBA during the day and 45 dBA at night. For example, 100 dBA - concert, chainsaw, thunder. Baby crying and dripping water are not included. Religious chants too. Noise associated with the elimination of the consequences of catastrophes, natural disasters, accidents is also considered an exception. But the drifting car under the window is not.

But in the first year and a half after the apartment building was officially commissioned, noisy repairs can be carried out during the day, but not at night. It is not specified whether this applies to an individual house. After all, there is no separate law that regulates noise in summer cottages and in country houses.

From August 6, restrictions on carrying out repair (noisy) events in the MKD from 19:00 to 9:00 and from 13:00 to 15:00 were lifted on weekdays, from 19:00 to 10:00 and from 13:00 to 15:00 on Saturday, and also around the clock - on Sunday and holidays.

SNT is mentioned in existing laws

For now, as the lawyers advise, you can count on laws regulating noise in a certain region. If the site is in the suburbs, then this is "On ensuring peace and quiet for citizens in the Moscow region." Areas for gardening and horticulture are mentioned here. In the Nizhny Novgorod region, the law also includes garden plots, as in the Tyumen region. But, alas, there is no separate law on silence in summer cottages, country and cottage settlements, country houses. Perhaps the new project, which will be discussed in the spring, will change something.

There is still a problem - how to prove that the neighbor was noisy. Video recording can help, as well as calling a noise meter from Rospotrebnadzor (exit is paid).

Law on neighbors in the country

The authorities plan to adopt a set of rules in the Civil Code, which will regulate relations between neighbors in summer cottages. The project will affect the shading of the land (when the building or tree of a neighbor casts a shadow on vegetable garden, which prevents plants from developing), the spread of smoke, the placement of sewer structures and etc. Among other things, officials talked about noise and vibrations at the dachas.

By the way, there were reports about the beginning of the autumn migration of vipers in the Moscow region. Cold nights force reptiles to seek shelter in summer cottages. Elena Kazimir, Chairman of the Forestry Committee of the Moscow Region, advises to be careful, look at your step and create noise around you, for example, when picking mushrooms in the forest.
