A neighbor builds a house close to the fence ("to fight" or not with a neighbor?). Construction norms
There are often times when neighbors are building a house close to your fence.
It's just that some people want to do everything their own way, without taking into account the current rules. Sometimes they just don't know that it is impossible to do this, and then they decide the issue in court.
How to avoid disputes between neighbors in the country and register your building on the site without problems?
By the way, the Russians can again register the ownership of garden, country houses in a simplified version. The term was extended until March 1, 21.
According to the set of rules for development and planning (SP 53.13330.2011), if your site is above 6 acres, then you need to observe the following minimum distances:
- the distance from the passage (red line) is not less than 3 m.,
- from the streets (red line) at least 5 m.,
- from a neighboring fence - at least 3 m.,
- from the bathhouse - not less than 8 m.
When building, you need to take into account all the norms so that later the neighbors do not sue you.
So, a residential building should be built no closer than three meters from a fence with a wicket and a gate. In this case, the distance is taken not from the foundation, but from the protruding element of the building. For example, a roof overhang.
Household. buildings (chicken coop, shed, etc.) at a distance of 4 m. from the neighbor's fence. You cannot build pitched roofs of buildings that are directed to an adjacent site.
The bathhouse should be located from 1 m to the adjacent fence. And then under the condition that the drains go into the sewer.
If you have a brazier, barbecue, smokehouse, then the distance from the neighbor's fence should be up to 3 m.
Reducing the distances listed above is not subject to fire safety regulations.
If buildings made of non-combustible materials (a house made of stone, concrete, reinforced concrete, etc.), which are located on opposite sides of the driveway, the distance must be at least 6 m. Between timber houses - at least 10 m.
Not a pleasant case happened with us. A neighbor started building his house at a distance of 1 meter from our fence. We began to tell him that this is not possible, there are rules and even showed a link.
But the neighbor did not listen to this. He only said that we had put the wrong fence (supposedly on his site). But this is not the case. Now I don't know what to do: leave everything as it is (keep the peace and let the neighbor do what he wants), sell the dacha or go to court.
I know that the proceedings will take a long time and not pleasant conversations, quarrels are inevitable. What would you do?
