State Duma approves: dacha amnesty will be extended for another five years

The dacha amnesty will most likely be extended until March 1, 2026 - the State Duma Committee on State Construction and Legislation recommended the adoption of the corresponding bill in the first reading. Owners of houses and land plots who have not managed to legalize their real estate in a simplified manner in 14 years (the dacha amnesty has been in effect in Russia since 2006) will have another five years for this.

What is a dacha amnesty?

In just 14 years, more than 13 million real estate objects have been legalized in a simplified manner. Recall: the dacha amnesty allowed without a trial, in a simplified manner, only on the basis of title documents and a technical plan, to register a land plot and a house that was built on it. It was introduced on September 1, 2006 and was in effect until last year. Now it will be extended.

But - after the new law comes into force, the simplified procedure for registering real estate under the dacha amnesty will not be so simple.

A number of provisions of the amnesty will be valid only until March 1, 2021. After that, it will become more difficult to issue the rights to residential and garden houses located on garden plots: at first you will need to send a notification about the beginning and completion of construction, and then go through our favorite quest approvals.

People who started construction without permission before August 4, 2018, that is, before the notification procedure came into force and they did not receive permission, will find themselves in a very special situation.

After March 1, 2021, they will be able to register their houses only through the courts, and they still have to prove that this is not an unauthorized construction, that the house meets all building standards.

Until that time, it will be possible to legalize the construction site by submitting only one notification (on completion of construction), and the house will be checked according to a simplified scheme: do the parameters of the house correspond to the limit (no more than three floors, no higher than 20 meters, one apartment in the house and other).

How is the new law different from the old one?

But the new bill suggests expanding the dacha amnesty of individual residential and garden houses to plots with several types of permitted land use:

• garden;
• plots for individual housing construction;
• plots for private household plots.

To formalize the title to a house, the owner of the property must have a registered title to the land plot - based on the technical plan and declaration. You can apply to the registration authorities yourself.
