Equipped summer kitchens of gardeners can be recognized as self-built and demolished

The authorities believe that such structures are subject to registration, otherwise the structures will be classified as unauthorized buildings. And the squatter will have to be dismantled at your own expense.

The dacha amnesty will most likely be extended for another 5 years. According to Nikita Chaplin, chairman of the Moscow Region Summer Residents' Union and First Deputy Chairman of the Moscow Regional Duma, this is partly due to the pandemic and quarantine.

Due to the danger of infection, as well as the inability to spend holidays at foreign resorts and remote work hours, many Russians chose to move out of town. The demand for summer cottages, individual houses and cottages has increased. Urban planning requirements for garden and residential buildings are the same. You can register at the dacha. Therefore, the issue of decorating such housing has become especially relevant. According to officials, the simplified procedure for registering dacha real estate (dacha amnesty) is a convenient solution.

Register everything that cannot be "moved"

Many on the site have not only a house, but also other buildings. And Nikita Chaplin recalls that all capital structures can be registered in a simplified manner. These are sheds and garages. The main criterion is the stationarity of the object. Brick walls cannot be moved - which means, the official specifies, this is a capital structure.

He also noted that there are summer kitchens, which can also be considered capital - with electricity and running water, equipped and comfortable. And since August 2018, an amendment to the Town Planning Code has been in effect on the recognition of construction as unauthorized - that is, unregistered. If this happens, then the summer kitchen will be required to be demolished at their own expense. Therefore, Chaplin recommends contacting a cadastral engineer, draw up a technical plan and register the structure.

You can complain about a neighbor using a mobile service

In Lyubertsy alone, 16 complaints were received by Glavgosstroynadzor (from conscientious citizens) about unauthorized construction in one week. There is even a service through which residents help inspectors find unauthorized buildings from a mobile phone. You just need to point your smartphone's camera at the object. If there is no information about the construction in the database, then a statement is left on a special portal, which is automatically sent to Glavgosstroynadzor.

Boundary errors

It is impossible to register a building without defining the boundaries of the site (land surveying). It happens that system registry errors are made, and then registration is suspended. According to the first deputy chairman of the Moscow Regional Duma, it often turns out that a whole array of plots was put on cadastral records with errors. For example, the owners have no disputes over fences, the linear dimensions correspond to the documents of title. But when an engineer “ties” a structure to coordinates, then formally he finds himself on a foreign site. Then you have to call the same specialist who draws up new boundary plans in order to correct the errors.

But if the neighbors do not want to pay for surveying again, then the problem is solved through the courts. And this, as Chaplin specifies, may take six months or a year.

Laser for complex cadastral works

In September, it was said about the intention of Rosreestr to introduce the technology of three-dimensional laser scanning for carrying out complex cadastral works. Already now, in Dagestan (in Makhachkala, in the Gunibsky, Kazbekovsky and Suleiman-Stalsky districts) new equipment is being used as part of a pilot project. By December, 8.5 thousand sites and 5.5 thousand buildings will be scanned in the republic.

According to Oleg Skufinsky, head of Rosreestr, this will increase the accuracy of measurements and reduce labor costs (fewer workers will be required). Upon completion of the project, the new method is planned to be distributed throughout Russia.
