How to behave if the price differs in the store at the price tag and at the checkout
In the event that you are a rather aggressive person, irreconcilable and like to defend your rights in everything, this article will not interest you.
But personally, I do not like to make trouble and attract undue attention to myself. Therefore, I try in every possible way to avoid situations in which I would have to eliminate the injustice that was committed against me. It's not that difficult, you just have to think about what you are doing and saying. Then you don't have to prove something to someone later. But, of course, if my rights are in fact violated, I do not allow anyone to enrich themselves materially or morally at my expense.
Unfortunately, these things can happen anywhere, for example, in a chain store. For example, the price tag shows one price, but at the checkout it is discovered that it has increased significantly. The reason can be anything: "The promotion is over, the goods are from a new batch, they did not have time to update the price tag." How to be in this case? Pay the price from the checkout, or from the price tag?
What does Rospotrebnadzor say?
In this case, Rospotrebnadzor is completely adamant - the price must be the one that is displayed on the price tag. The reason is that the Law of the Russian Federation "On Protection of Consumer Rights", article 10, as well as the Rules for the sale of certain types of goods, paragraph 11, indicate that the buyer has the right to receive information about the price and conditions of sale through the price tags installed on the windows and counters. Thus, the price for 1 kg or a piece product must be real precisely on the price tag.
What does the Civil Code say?
The Civil Code of the Russian Federation has the following definition: an offer. Not everyone is familiar with the word offer - this is a documented offer. At each point of sale, the public offer is nothing more than a price tag. Only he is the document that offers the buyer a price for this product. That is, the cost of the goods indicated in the offer is final.
When the facts of the difference are revealed, sellers usually explain that they did not have time to update the price tags. And some even begin to put pressure on pity that now it will be deducted from their salaries. But the buyer must understand that everyone has their own job. And everyone must fulfill their duties conscientiously. And changing the information specified in the public offer is the direct responsibility of the seller. This obligation is fixed in the "Rules for the sale of certain types of goods", clause 19.
What to do in such a case?
You should contact the store administrator, describe the reason for the disputable situation and demand the sale at the price indicated on the price tag. If the conflict is not resolved even by the administrator, then you should fill out a complaint in the book of reviews and suggestions. If it is not given, then the store commits an offense under Art. 14.15 Administrative Code.
In the book - describe the situation, take a picture of the book, your claim, check that all the pages of the book are in place. By the way, the price tag also needs to be photographed along with the product.
If, even with such an action, the store does not want to return the difference, then a written application should be made to Rospotrebnadzor.
