What is non-residential property?
I recently wrote about the concept of "housing stock" and its components. Today I will tell you about what a non-residential fund is, what premises it includes, and what characteristics they have.
The object of the non-residential fund is non-residential premises. Non-residential fund is a collection of all non-residential premises located on the territory of the Russian Federation. The difference between non-residential premises and residential premises lies in the fact that non-residential premises are unsuitable for permanent and temporary residence of people; registration cannot be made in it. In non-residential premises, it is allowed to carry out any activity that does not contradict the legislation of our country. The activity may be of a commercial nature for the purpose of obtaining a profit, or it may have a non-commercial purpose. Both owners and third-party people can conduct activities in non-residential premises under a lease or lease agreement.
Non-residential premises included in the non-residential fund of the Russian Federation must meet certain established requirements:
- Be a real estate object,
- Have a separate isolated entrance,
- Not used as temporary or permanent housing for people
- Used for economic, educational, commercial and other activities,
- These premises must meet fire safety requirements, building and sanitary standards,
- It should not be included in the group of emergency or dilapidated buildings.
Most often, non-residential premises are detached buildings or premises located on the first floors of buildings. In modern new buildings, the first floors are immediately assigned to commercial activities. But in the old housing stock, the apartments on the first floors were residential, and now they are increasingly being re-planned for commerce. Do not conduct commercial activities in residential premises. Therefore, before starting to do this, it is necessary to transfer the residential premises to the status of non-residential. For this it is necessary that the premises meet the listed requirements. In addition, when re-registering the status of residential into non-residential, it is necessary to take permission from the interdepartmental commission, which will conduct an inspection and analysis.
It is most optimal if the commerce is located on the first floor of a high-rise building. There will be no problems with a separate entrance from the street. But it happens that the owners want to re-register a residential apartment in a non-residential premises on 2 or 3 floors. In this case, it is important that there are no living areas under your premises.
