At whose expense registry errors will be corrected: assessment of the Union of Russian Gardeners
Rosreestr refuses to register plots, the boundaries of which go to neighboring plots. Citizens who have undergone cadastral registration 10 or more years ago face problems. Land owners require a new cadastral registration. But the question arises - who will pay for it?
The Union of Gardeners of Russia gave its assessment of what was happening: it was explained here that in this situation, there is probably an error in the register, and it was made by the person who performed the cadastral work. There are several ways to fix the problem.
What can be done?
Option 1
Rosreestr conducts a comprehensive cadastral registration procedure to eliminate errors. This option will be implemented if on the territory of SNT there are many sections with erroneously established boundaries.
Option 2
The owner of the site submits an application to Rosreestr, and attaches documents that convincingly prove the existence of a registry error. In this case, you need to contact the cadastral specialist who made a mistake or have a court decision that has entered into legal force.
Option 3
The rightholders of neighboring land plots decide the issue of the boundaries of the plots among themselves, make an agreed and uniform decision on the land boundaries; constitute an act of approval. After this procedure, the cadastral specialist makes changes to the boundaries in the Unified State Register of Real Estate.
Option 4
This method is the most expensive and emotionally costly, since it is resorted to by the owners of the plots who could not come to a common agreed opinion on the boundaries of the site, and also believe that correcting an error in the register violates the rights of owners or third parties. This is litigation. This will require both expensive expertise and the services of land lawyers.

Having such large-scale problems of citizens on the agenda, according to the conclusion of the parliamentary online hearings dedicated to the results of the first year application of the law "On gardening and horticulture", the Union of Russian Gardeners plans to begin the procedure for collecting and processing applications from SNT Moscow region. The result of this event will be the implementation of complex cadastral works. The Union of Gardeners wants to save citizens from unnecessary financial costs for correcting errors that have arisen through the fault of the Federal Register and cadastral specialists.
