Features of national energy supply: who and how should pay for light in SNT

Paying for electricity in SNT is always a painful issue. Many members of gardening partnerships are constantly experiencing some kind of wild stress about this: you pay regularly, and the neighbors insolently steal electricity; or there are new levies for the repair of electrical equipment; or technological losses of networks reach 20%, and for some reason you have to pay for them, although - here's a receipt!

Who should monitor electrical equipment in SNT

Recently, one such story about the uneasy relationship between a gardening partnership and power engineers reached the Supreme Court, which sided with the gardeners. It turned out to be a common situation. Many horticultural associations may benefit from VS clarifications.

This story went on for a long time: as soon as a new horticultural partnership was formed. The power supply company began supplying electricity there and for ten years everything was fine with everyone. Power engineers have never checked the equipment, the first check took place ten years later - it turned out that the transformer was useless, it was outdated morally and physically. Power engineers demanded to replace the transformer. SNT collectively answered in the sense that you need - you and change. After long disputes, the gardeners themselves changed the transformer, since the owner of the electrical equipment is the partnership.

So the gardening in-house replaced the transformer and for seven months everything went well. SNT transmitted meter readings to power engineers and paid the received bills. But then the power engineers checked and saw that the transformer was not sealed and demanded gardeners to pay "unaccounted energy consumption" for the past seven months in the amount of more than 1.2 million rubles.

The first instance court ruled in favor of SNT; the court of second instance found that since there were no seals on the transformer, then, therefore, unaccounted electricity consumption was evident. Power engineers insisted that SNT had to notify them in writing about replacing the transformer with a new one, but this was not done. In search of justice, members of SNT reached the Supreme Court. According to them, the old transformer worked without seals for all 10 years, and the power engineers have never bothered about this. They haven't checked how the electrical equipment works for years, and for seven months they billed the new transformer without bothering to check if everything was in order.

Now the majority of SNT are trying to transfer the power grids that they own to power sales companies. And with them the obligation to service, repair and replace the transformer. But this does not always work out - it is unprofitable for power engineers.

Can SNT turn off the electricity to the summer resident

Now in Russian courts there are many cases of charging payments for electricity, including from horticultural associations and their members. People often have questions related to the powers of SNT in their new sub-executor status introduced in 2019 year - an organization (including horticultural and vegetable gardening), which does not provide services for the supply electricity. Until 2019, members of horticultural partnerships usually paid for electricity through SNT.

Now SNT, as a non-profit organization, is prohibited from making cash payments with gardeners; gardeners draw up contracts directly with the electricity supplier. But SNT is the owner of the power grids.

Even in a properly designed power transmission line, electricity losses at the level of 5% are inevitable; in an incorrectly designed power transmission line (or operating with overload), they reach 15%. An overloaded transformer gives an additional 5% loss. All of these losses are paid by the horticultural members. The amount of technological losses is indicated in the contract that SNT enters into with power engineers. And to pay for them, SNT introduces special contributions.

According to the current version of the Decree of the Government of the Russian Federation "On the functioning of retail electricity markets ...", SNT has the right to restrict the supply of electricity to ordinary gardeners.

The reasons may be:

  • power outages for non-payment of contributions;
  • disconnection for non-payment of utility bills;
  • By the tribunal's decision;
  • if the contract has expired.

But the SNT chairman does not have the right to simply take and turn off the electricity, according to the law he must conduct a detailed check, and if violations identified, send a written notice to the owner of the site (by e-mail, or delivered in person, against receipt or by phone, with a record conversation). The notification always indicates the time frame in which the debt must be paid off (the law gives 20 days for this), and only if the violations are not eliminated, turn off the electricity.

The SNT chairman has the authority to turn off even individuals - they are also required to pay for utilities and participate in reimbursing technological losses. When individuals think that they can use SNT networks, but they cannot pay for it, such situations arise.

In the decision of the board it is written: I made a deal with sales, which means that SNT ceases to be a guaranteeing supplier and is not obliged to supply electricity. "

Can power engineers turn off electricity throughout SNT

In Saratov, in January last year, power engineers cut off electricity to the entire SNT just because winter had come. And in winter, according to energy sales, the dachas do not need light, they are also intended for seasonal living. The gardening partnership won the court and the power engineers had to pay all the costs.

Previously, SNT was a subscriber of the energy sales company, and stories when power engineers disconnected it from electricity did not happen so rarely. But after all members of the partnership began to conclude contracts directly with energy sales companies, "this is contrary to the law, and therefore is excluded."
