Illegal buildings: on what areas near the reservoir is the construction of houses prohibited

In Russia, where it is cold and damp for most of the year, the house by the sea acquires special significance, it seems that there is no person who would not dream of it. But the purchase and construction of a house near the reservoir is limited by law. Experts from the Federal Cadastral Chamber told about them.

When planning to buy a house or a land plot by the sea, lake or river, one must remember that one of two zones with special conditions for the use of territories can be established next to water bodies:

• water protection zone;
• coastal protective strip of public water bodies.

Your site may be within their boundaries, and then problems may arise with the construction site.

What is the nature protection zone for?

The water protection zone is adjacent to the shoreline of the reservoir, and a special regime for economic activity operates throughout its territory. It is introduced to conserve water and keep it from pollution, and not to disturb the habitat of plants and animals. The width of the protected area depends on the size and type of water body.

Inside the water protection zones, like in the nesting doll, there are also coastal protection zones, and these are territories with even stricter restrictions. It is here that everyone would be happy to build a house, but this is prohibited by the rules of use. All you can do there is a beach and a fishing spot.

The land that stretches along the coast (coastal protection strips) is land of general use. It does not exceed 20 meters in width, and at short canals, rivers and streams (no more than 10 kilometers from source to mouth) - five meters. Any construction on the coastal protection strip is prohibited by law. And also this land cannot be redeemed from the state into ownership.

Land outside the coastline can be bought and rented. You can build both garden and individual houses on it. But all sanitary water protection standards and requirements must be observed; the house will need a special sewerage system, storm drains, wells, drainage installations, water purification systems. The house must be safe for a water body: do not clog it, do not silt it up, do not harm the water. In the water protection zone, many things are prohibited: it is forbidden to dump sewage and drainage water, wash cars, arrange landfills, graze cows, goats and other animals, and plow the land there. You can only move by transport on roads, and park cars in equipped parking lots with a hard surface.

How to find out if the site is included in the water protection zone?

We know where and how to see the water protection zones: in the department for architecture or land management of the local municipality, in the territorial administration of Rosreestr, Rospotrebnadzor or Rosprirodnadzor. Where they should be reflected - in the USRN statement, in the cadastral passport, in the urban planning plan of the land plot (GPZU).

An easy way to find out if a site is included in the water protection zone is to order an extract from the USRN. The online service of the Federal Cadastral Chamber will issue it in a few minutes, in the MFC you will have to wait 3-5 days, in Rosreestr too. In the Public Cadastral Map, water protection zones and coastal strips will be displayed if you select "Layers" in the toolbar, uncheck the "Zone with special conditions for the use of territories" box, find in the drop-down list "Natural objects ". You can look - on the map such zones are shown in green. But there is a catch here: if the zones are not included in the USRN, they will not be displayed! But now 11,903 water protection zones have already been included in the map, and most of them are in the Krasnodar Territory, as well as the Perm and Sverdlovsk Regions.
