There will be much more “land fines” in the Moscow region. We explain why

It will no longer be possible to evade punishment for violating land legislation: control bodies have switched to digital format.

Land inspectors of the Moscow region switched to digital and began to work much more efficiently; more violations are detected, fines are issued to land owners more often. We must be prepared for the fact that no one will be able to conceal violations of land legislation in the near future.

Paperwork is a thing of the past

Land inspectors are now using the Moscow Region Checks application. The digitalization of control and supervisory activities, about which land owners have been warned for a long time, has been going on since 2019, and it is much more difficult to hide violations than before. According to the estimates of the Ministry of Property Relations of the Moscow Region, municipal land control has become one and a half times more efficiently, mainly due to two innovations: the automation of the annual inspection plan and the mobile application for land inspectors.

Violations of land legislation began to be detected more often, and here are the top 3 favorite illegal actions of residents of the countryside:

  • self-seizure of the land;
  • non-use or misuse of land plots;
  • hogweed on land plots.

Why were violations detected worse in the past?

There are only 220 inspectors working in the Moscow region - and this is on almost 4 million land plots (with a total area of ​​about 4.5 million hectares). It was impossible to work at full strength due to the huge amount of paperwork, it was necessary to constantly fill out documents and write reports. Now all processes are automated, and inspectors have more time for their own control and supervision. Paper reports of inspections and examinations and lists of participants are a thing of the past. And if in 2018 inspectors were able to inspect 26.5 thousand land plots (less than 1% of all plots of the Moscow region), last year there were already 30.5 thousand plots, and this year 40.4 thousand. land plots (almost 700 thousand hectares).

Work on the annual plan of municipal land control took a lot of time. Since 2019, this process has been automated; the plan is drawn up by the program using a risk-based approach. How the program works: it takes into account the category of land; VRI site; land area; form of ownership; the presence of borders, etc.

Each criterion has its own weight, which can vary - it depends on the purpose and task of the test.

That is, the program enters into the check plan those areas where violations can be found with a high probability. So, hogweed will be looked for primarily on agricultural lands, but not only - all criteria will be summed up.

Benefits of digitalization

Automation has eliminated a number of bugs in the work of the land service: now different authorized bodies do not check the same plots, as it happened before; areas to be checked are selected only according to objective criteria, etc.

How the "Moscow Region Checks" application works: it has an electronic checklist, the function of photographing the violation and the geolocation of the inspector who conducts the inspection. At the site, the inspector answers the questions of the checklist on the gadget, confirms the answers with photographs and geolocation, and that's all. The system itself generates the necessary materials in the Unified State Information System for the Control and Supervision Activity of the Moscow Region. As a result, in 2020, each inspector was able to inspect twice as many sites as before this application appeared: in 2018, an average of 81 sites, and in 2020 - 179 sites.

Inspectors found violations at 210,000 inspected sites, charged more than 258.2 million rubles of fines. Most (more than 210 million rubles) of fines were issued to the rights holders of land plots who avoided fighting the hogweed. It is clear that not all land owners are happy with this.

The effectiveness of the work of land inspectors is growing - it can be expected that next year they will inspect even more plots and reveal even more violations. Land plot owners need to be ready for this and eliminate all violations in advance.
