Once upon a time, back in Soviet times, there was a fashion for decorative fences and flower beds from old car tires. They were buried halfway into the ground or simply placed on the surface and painted in all the colors of the rainbow. For lack of anything better, these compositions were pleasing to the eye and brought at least some variety to the gray reality. And the fences made of them are relatively safe - you dig in the yard, and even if you hit it with a car, it won't cause much harm. Convenient and, most importantly, completely free. But now for flower beds, fences and sculptures made of car tires can be fined. What is the matter and how to avoid it - read on.
What is the meaning of the law and how much is the fine?
The fact is that automobile rubber belongs to the IV class of hazard (low-hazard waste) and can harm the environment. It contains carcinogenic substances, some of which have a decomposition period of over 100 years. All this can get into the soil, groundwater, water bodies. By law, car tires must be disposed of in specially designated areas. It is impossible to litter nature with them - this is the law (Part 1 of Article 8.2 of the Administrative Code).
Logically, this requirement also includes the use of car tires for the manufacture of fences, flower beds, sculptures, children's attractions and sports simulators; their use to strengthen coastlines and the construction of other structures. The following fines are imposed for violations of this law:
- Individuals who own land plots will pay up to 2 thousand rubles for the initial violation. rubles; for repeated - 3 thousand. rubles.
- Legal entities face a pecuniary punishment of $ 100,000 to $ 250,000. rubles.
How to avoid a fine?
Imagine a situation: a police officer or Rospotrebnadzor fixed a fence, a flower bed or just tires lying on the ground on your site and issued a fine. This protocol has legal force if the representative of the law has recorded precisely the fact of illegal disposal! But if you say in court that you use these tires as the same fence or flower bed - then the law is powerless here, since it does not reuse / use car tires prohibits.
If you litter the area with old tires or burn them, you will be fined. If you use a product / products made from these tires and can prove it - there will be no penalty!
