The state will select sites for violation of fire safety rules

The Ministry of Economic Development has prepared amendments to the Federal Law "On Fire Safety", according to which for non-observance of the fire safety rules of their plots may be lost by farmers, summer residents, entrepreneurs and physical faces. The reason for the seizure of land may be an unrefined plot or its adjacent territory.

Problem

Victor Nikolaev, Head of the Board of SNT in the Taldom district of the Moscow region:

“Every gardening partnership has neglected areas where the owners have not been visiting for many years. If you do not process, do not mow, you can lose. This is true from the point of view of general fire safety. And, most likely, the new law will spur those who are not able to put the dacha in order to sell it. Good initiative! "

Decision

In connection with the increased frequency of fires, lawmakers are tightening the punishment for an area overgrown with grass, untimely mowing of vegetation, and rubbish heaps on the territory. Now violation of fire safety rules costs fines: 5 thousand. rubles for ordinary citizens; 50 thous. rubles to officials; 1 million rubles for legal entities. Now it is planned to confiscate land plots from owners and tenants who break the law. The origin of the property in this case does not matter - whether it is bought or inherited.

How will the seizure of the land take place

Fire inspectors will give six months to eliminate violations (mowing grass, garbage collection). If within six months the landowner does not take measures to clean up vegetation and debris, municipal officials will go to court demanding the withdrawal of land property from the owner. This requirement will not apply to bankrupts and persons who have acquired land on a mortgage loan.

Further, the seized land will be sold at auction at the market price, and the money, taking into account the costs of legal proceedings, will be given to the failed landowner. The seizure will not take place according to the type of expropriation in favor of the state - the procedure is aimed at changing the negligent owner to a more responsible one.

How not to lose a land plot

Everything is very simple - to comply with fire safety rules, namely: remove the grass in a timely manner; to clear the area from branches, trunks of fallen trees, felling residues; do not leave mountains of rubbish. And also if the site borders on a forest, it is necessary to clean 10 meters of the adjacent area from vegetation and combustible materials.
