Didn't have time - it doesn't matter! MPs want to extend dacha amnesty until 2026

The deputies will consider the bill "On Amendments to Certain Legislative Acts of the Russian Federation." The new law calls for the renewal of the "dacha amnesty" until 03/01/2026.

The dacha amnesty lasted thirteen years. During its operation, several million citizens of the country have used the simplified mechanism for registering rights. But not everyone managed to do this. This was the reason for the initiative to renew the dacha amnesty. Lawmakers advocate not only the restoration of this project, but also the expansion of some of its functions.

"It would be correct to protect their rights not only by extending the term, but also by involving other objects in the 'amnesty', reducing the financial and psychological costs of citizens."

The dacha amnesty will be prolonged and its functions expanded

The new law, initiated by Pavel Krasheninnikov, provides for the full renewal of the dacha amnesty until 03/01/2026. Thanks to this, it will be possible, using a simplified mechanism that has worked before, to issue the rights to residential buildings, country and garden houses. The mechanism for registering rights to real estate objects will be carried out in the presence of a right to land and a technical plan, which the owner will have to draw up in accordance with the declaration of the object. The filing of documentation to the registration authorities is carried out by the owner of the property independently.

For objects under construction, the construction of which began before 04.08.2018, a new and simpler notification procedure for construction and registration of rights will be formed. The new mechanism provides for the submission of only one notice of completion of construction, instead of two, as was the case before. The verification of the new house will also be carried out according to simplified rules: the compliance of the data that the owner indicated in the declaration will be checked; the limiting parameters for the construction of residential and garden houses specified in Art. 1 Civil Code of the Russian Federation.

Transition period

Until 03/01/2021, a transitional period will be in effect for persons who have started construction, before the start of the notification procedure.

Pavel Krasheninnikov notes:
"These citizens have the right to notify the authorized body about the construction, and they do not need to take permits: for construction; to commission the facility. If citizens do not notify the authorized bodies before 03/01/2021, after that date they will have the opportunity to legalize the building only through the courts. It should be noted that this will happen if these citizens can prove that their house is not an unauthorized building, and it does not violate building codes. "

Submission of documentation to Rosreestr will be simplified

And also the legislators made an additional proposal regarding the registration of rights in Rosreestr and the filing of documentation. From 04.08.2018, local self-government bodies were engaged in this, which submitted documents after inspections at the end of construction. This mechanism allowed delays, bureaucratic failures, and facts of local abuse. The new mechanism will give citizens a choice - to submit a package of documents to Rosreestr on their own or wait for them to be sent by local government bodies.

In addition, a proposal was put forward for SNT participants to extend the rules for buying land until 03/01/2026, publicly owned, allocated for horticultural activities, vegetable garden and dacha farms.

Currently, members of garden non-profit partnerships are endowed with the right to acquire land plots in ownership free of charge without bidding, in the event that the site is allocated from the land provided by SNT prior to the Federal Law "On the Enactment of the Land Code of the Russian Federation" (before November 10, 2001 of the year). These rules end on 31.12.2020, but the new law provides for their prolongation until 01.03.2026. This will ensure the rights of members of gardening non-profit partnerships, to which land was granted prior to the current land law.
