Elimination of "dead" SNT in the Moscow region: what are the reasons

In 2020, work continues on the creation of a complete "Register of summer residents" in the Moscow region. This is a lengthy procedure that requires a careful approach to the consideration of documents of already existing SNT. More than 8 thousand horticultural non-profit associations are registered in the MO, land has been allocated to them, but they do not show any activity. That is, they can be “dead souls”.

Virtual SNT will be eliminated

Officials say that this type of virtual SNT, which does not have checking accounts and does not provide regular tax reporting, will be eliminated. Of course, horticultural non-profit partnerships are complex organisms, both from a legal point of view and from a human relationship point of view. Therefore, the liquidation procedure also cannot be the simplest. This process is regulated by Federal Law No. 217-FZ.

Preconditions for liquidation may be:

  • transition of SNT status to a rural settlement;
  • expiration of the term of the agreement on the activities of the partnership, signed by the founders;

  • excess of the cost of servicing SNT, available through voluntary contributions;
  • tax arrears;
  • lack of financial activity;
  • the number of participants is less than seven people;
  • refusal of SNT members to register plots in the cadastre.

Bona fide owners will not be deprived of land

According to the chairman of the public organization "Moscow Union of Gardeners" Andrey Tumanov, the liquidation of SNT possible due to the absence of the chairman (for example, when he was elected with an incomplete quorum, which was proved in court). And he also highlights problems with documents that need to be put in order, otherwise the partnership is also subject to liquidation. However, almost everyone has similar problems - if you find fault.

It is noted that, despite the tough approach, the liquidation of SNT will not be the reason for depriving the owners of their land. If a member of the partnership has already begun to develop the site, and also carried out the procedure for transferring the site into ownership, there is no reason to worry - the liquidation of SNT will not affect him.
