Farmers will be able to build a house on farmland lands
A bill providing for changes to the Land Code will be considered at the autumn session of the State Duma. How it will be and what restrictions are provided - read on.
Problem
In many cases, it is impossible to change the type of permitted use (VRI) of the site, and the federal law that would regulate the use land plots for which urban planning regulations are not established and the procedure for zoning territories is determined, not exists. Formally, farmers have the right to build on their land, and it is written in the law on peasant (farm) economy, but this law contradicts the Land Code.
Vladimir Plotnikov, Deputy Chairman of the Agrarian Committee of the State Duma:
“Often the land plot is located at a great distance from the farmer's residence. The farmer should be able to live on his land, and not go to his land every day as to work. "
Decision
Farmers can be allowed to build houses on agricultural land: such a bill will be considered by State Duma deputies in one of the autumn sessions. It is expected that the new law will generally improve the system for determining VRI plots: a new chapter will appear in the Land Code that will regulate the establishment of defining and changing the VRI of plots, for example, it will be possible to establish and change the VRI of agricultural land, which are farmland, at the regional level. Regional authorities will be able to resolve these issues, taking into account the characteristics of the development of the region and the needs of the population.
How would this happen
Among other things, it will be possible to build a residential building on the site that is provided to the farm, however, near such a house will have several parameter restrictions to avoid abuse: the total area is no more than 600 sq. meters, building area no more than 5% of the total area of the site. The house cannot be sold without the rest of the land, just as it is impossible to sell the land, and keep the house with a small plot for yourself. These restrictions will prevent the conversion of agricultural land into building plots with subsequent sale.
These issues will be dealt with by the Agrarian Committee of the State Duma, the Association of Peasant (Farmer) and Agricultural Cooperatives of Russia (AKKOR).
